    If I-140 has been certified OR application has already been submitted, then maybe you DO need a employment letter - to prove that the job is still available.

    If I-140 and 485 are being submitted concurrently, then OBVIOUSLY there is a job offer (thats part of the reason the I-140 is filed by company) and maybe the employment letter is not required.

    My thoughts.

    You are right on both accounts.

    1. I-140 already approved: Yes. A job offer should be attached with the 485 application as the 485 is your application. Is not including the offer letter grounds for rejection for lack of initial evidence? Probably not. But it is almost certain to invoke an RFE.

    2. Concurrent Filing: As 140 is applied by the employer and not by you, that by itself is evidence that at this time, this employer intends to hire you or continue to employ you after GC. No separate letter is needed.

    Will she get paid starting Feb 1st? If no, why not. Please explain.

    She wont get paid starting Feb 1 but there is an option to get paid from Feb 1 - April 20 as she accumulated some $ when she was working and after April 20 she will be on maternity leave which will be unpaid.

    To answer why she will not get paid - she does not have a project right now and dont even plan to find one....(bad economy and no one will be willing to employ a preg. female who will need 6-8 week vacation after 2 month of hire)

    Will she on unpaid leave? Yes.

    Will she still be Full Time Employee? For the employer C which is a desi consulting firm she is a FTE but you know how the consulting business works........as long as you are on project you get your salary and the day you are not on the project you dont get a dime.

    On H1 Status, one must be working full time and should be paid salary even if s/he is on benching. Three month maternity leave should be ok, but 6 months of unpaid leave will be very difficult to explain.

    You should seriously consider changing status to H4, if that is an option.

    In Nov, she can re-enter on H1 visa to come back to H1 status.

    There is a non-profit organization (like Business & Media Institute (http://www.businessandmedia.org/about/about.aspx)) that reports on wrong media reports. They have lot of reports on Lou Dobbs.

    The details were posted in one of the many Lou Dobbs Threads. I can not find it.

    If anyone can find it please post details of the organization and send email to this organization also.

    Misrepresentation of facts regarding the recent rally in Washington DC. The rally was about increasing the number of Green Cards, and not H1-Bs. This reporter - Eileen Zimmermann has clearly gotten the two distinct issues mixed up.

    The intent of the rally was to garner support and highlight the inefficiencies in the immigrant visa(also known as green card) process. This is different from the H-1B issue.. H-1B is a highly-skilled temporary work visa.

    I ask that CNN must immediately issue a correction to this article to reflect the correct information.

    WRONG.
    YOU are an EB2 India guy for sure and your PD is close.

    If spillover happens, all visas will get used up by EB2 India only. EB3 India gets nothing. There are way too many Indians in the system. Even if something is left from EB2 India, EB3 ROW will get breadcrums.

    EB3 India gets nothing. So stop giving wrong logic. I will oppose IV helping EB2 guys with close priority dates and not caring about everyone else.

    Well, No wonder why we still could not pass any bill in our favour, Keep fighting Dude, EB1 vs EB2 v EB3 v horozontal spill vs vertical spill vs etc etc etc., Keep fighting....you are a good samaritan......

    Hi Guys,

    My attorney sent the response last week and it was delivered to the Dallas, TX. I am little concerned that my attorney actually sent the response to a courier address rather than the PO Box for TSC that they ask you to send. So far I have not seen any updates on my case.

    Vgayalu: After how many days did you see an update after you sent the response to the RFE.


    RFE received date : 09/07/10
    RFE Response sent (MAIlED) : 09/29/10
    (IN USPS to PO BOX by Express mail)

    RFE Response Received by USICS : 09/30/10 ( On line update on same day). - Hard LUD

    Again there is one more soft LUD on 10/01/10.

    Approval update : Hard LUD 10/05/10.

    I think you are absolutely right. The only chance that legals have is through a CIR. I have been watching the trends for the last 3 years and everytime anyone wants to put anything for legals, it is shot down. It is not that house and senate can;t do it but it will be a political suicide. It really doesn't matter - you are democrat or republican. All Americans are afraid to lose jobs. They are concerned about immigrants taking away jobs. In my opinion, things will continue like this at least for next couple of years or so.

    if you read previous discussion and particulary logiclife post, you will find, any immigration reform bill will not be discussed let alone passed until it resolves illegal immigration issue

    gone are the days where h1b increase use to be part of some budget bill.

    you just can't do that any more

    only chance SKILL has is thru CIR or other forum where it address illegal issue,

    my point is we don't need any legislative change at this point,

    IV is for legals who are already here legally and our demands are very simple, such as if they allow use to file I485 with being current and if they use unused visa numbers and allocate them to over subscribed countries our life will be lot better,

    we need to rethink our stratergy and stop knocking these law makers, who cares only about illegals, either they are against them or far them, but they just don't really care about legals

    I got a reply from USCIS saying that they can process the request sorted by priority date and country of birth of the applicant. Processing time will be around 15 months and that they have got their answer on priority date.

    what are the next steps?

    As far as dates for India goes, its out. Bulletin on USCIS website will have details for all other countries as well which doesn't matter much to us...

    Hi, Did you send the AC21 letter yourself? Can you please let us know the format of the letter and supporting documents you sent? Also, please share the format of G-28 explanation. How was your experience so far? Did you receive any confirmation back from USCIS? Thanks.

    meimmi, we are still working on it.
    might end up hiring a lawyer only for filling AC-21. I know its not a big deal, but still trying to be on the cautious side.

    We also had the same questions as u had and were not able to find anything.
    If you find anything please share it with us also. We are going to file this week for sure.

    Please correct your spelling of Murthy. I thought some senator or Congressman Murphy wrote to DOS. If it was murthy I wouldn't have bothered to come on this thread. She is a big time crook. Shamelessly she's trying to take credit of everything that we are doing here under 1 banner called immigrationvoice she will take credit of Zoe Lofgren and everybody else. She has never ever mentioned immigrationvoice for anything in her so called updates.

    Like I said before, W2 should be good enough. If you get employment letter for that period, that will be better.

    Typically LCAs are not needed, unless asked to prove H1-B status for job location and other related issues.

    I came to US through CompanyA on L1A Visa 4 months back. My L1A Visa is valid till Mar-09. I had applied for the H1B Visa when I was in India. I got the H1B Visa and now has a valid petition effective Oct-07.
    I would like to know the following.
    Can I join the Company B from Company A without going back to India after Oct-07?Shouldn't be a problem, but I need some clarifying

    Do you have an i-94 for the H1B visa? Do you have 2 visas in your passport - L1 and H1? Or so you have an a receipt issued by the USCIS for the H1B

    Please clarify
