Thank you very much for the response. I sent you a PM.

Now do we need to have the pay stubs for all the time to show you are in status or does the W2 amount be sufficient?

    Thank you.

I don't respond to Private Messages. If you have questions for me and would like to get my opinion on it, please post in forums here.

with StarSun. there are so many people in neighboring states (to DC) who can come during advocacy days, or atleast offer accomodation, hotel pickup drop offs. hardly anything to loose. its pathetic that people will line up for free lunch, but will not do anything to get it, even when there is nothing to loose.

my attorney says even if you send it today to be delivered on Monday July 2 USCIS might also reject cases delivered on july 2, if visa bulleten is revised on july 2. does anybody have any idea what USCIS did for others workers category, did they reject cases filed after June 5 or reject from June 5 itself (I believe June 5 was the date when DOS said they retrogressed)

No one knows what will happen on Monday, However, I think you should send out your application. I send my application on Friday and I don't know whats going to happen. I would rather send and wait instead of just waiting without sending. Who knows, I might sneak in huh :)

Yes. I VOLUNTARILY exclude myself from any such potential benefit. :)
I am surprised by the defence of this lawfirm in most of your posts on this forum.

And I am surprised by you using a contribution to Immigrationvoice as the only yradstick for working towards immigrant "rights"

By that yardstick neither of us can proclaim ourselves as being working towards immigrant "rights".

Note the quotes - a privilege cannot be a right. DUE PROCESS is your right towards attaing that privilege - we need to focus on that - not on what Murthy does or does not do or even more importantly what you expect her to do or not to do.

As i said, eb3 to eb2 porting is not easy....Unless, there is very strong case, like applicant having US Masters degree but employer filed in EB3 for reasons they only know....

    Read this story...

    http://immigrationvoice.org/forum/showthread.php?t=13810

What are you talking about? I have seen people granted H1 and GC (Under EB2) not even with graduate degree.. It is all paperwork game.

If I-140 has been approved, would it still be fine to apply for transfer from H1-B to F1 status by using form I-539 & university issued I-20 ? How long does it take to transfer status from H1B to F1 ? When can one start school . Only after I-539 approval or after only applying ?

For pursuing an MBA, does it matter if one is on F1 or H4 (spouse is on separate H1)
How long does it take to transfer status from H1B to H4 ?

Please look at the following post in For NIW and OsR applicants (http://immigrationvoice.org/forum/showthread.php?t=3081).

I am EB2,with an approved I-140 in NIW category. My PD is 16 jan 2003.since last 8 months dates moved only 7 days.I am in a pathetic situation, my children are studying in NY colleges and I am paying out of state tuition for them, I am pursuing my phd, the stamp in my passport expired and I came to India to get extend the dates on my F1, but the visa extension was refused saying when you have approved immigrant petition you cannot extend the non-immigrant visa.

The conflict of interest issue, the consul said you wait till your dates are current then you enter even after being the beneficiaries of my EB2.

I still don't believe that USCIS has no say in spill over - think again :)

Yes, the spill over can be implemented differently -- USCIS is implementing the EB1 spillover incorrectly. No law needs to be changed to get USCIS to act in accordance with the law as is currently written; However good luck to you convincing IV to lend support to any EB3 cause.

If USCIS wants to do another JULY 2007 they never learnt their lession. With the Quarterly/annual quota I dont think USCIS legally can make EB2 current. I hate another JULY 2007 for sure.

They can make a category current when Demand < Supply. So once all I-485s prior to 2007 are approved the monthly demand data they publish will show demand Prior to CY2011 = 200. So unless they use approved I-140 to determine demand , DOS will make the dates current(even if for 1 month). As long as USCIS uses pending I-485 data to determine demand, the July 2007 fiasco will keep on repeating every 3-4 years. The key here is to have USCIS provide the actual demand (people with approved I-140s). It was mentioned somewhere that the current USCIS database is not capable of sorting the I-140s by country of chargebility and hence the I-140 data can't be used to determine per country demand.

    Folks,
Although i did not miss the EVL i sent an incomplete G325A form without the foreign address and the foreign occupation.

I already have an approved I-140. Can i send a updated G325A based on my A#? or should i wait for a RN and then send it.

My worry is what if i don't even get a RN and get a reject?

When we file I485 its with Department of States and not USCIS which is part of Department of Home Land Security. In my opinion it is DOS who has to agree filing I 485 even if visa number not available.

hold on guys!!! i was the one who started this thread because i was not sure if ron was right or not but i guess seeing desi3933 comments that he is right and ron may not have the proof to justify this time.

it is good if we can get some proof of uscis wasting/not using visa but untill then please dont blame each other..

I feel the arguments desi3933 is giving.... makes most of the sense as compared to the last reply by ron which was like a general response instead of showing root cause of 13k visa lost.

    peace V

Please let me clarify. This is not a question of ambiguity in the meaning of the message. Its crystal clear. One immigration body shop said that 13K visas are wasted by USCIS. It has been proven with facts that the statement made by immigration body shop is factually incorrect. Its not the first time. But you continue to ask others to look for proof of USCIS wasting visa numbers even after looking at the data. I am totally perplexed by the obsession with immigration body shop when repeatedly similar inflaming messages have been discredited in the public arena. When is enough, enough.

Hi, I hope somebody helps in my dilemma.

I am currently on an L1A visa. I heard that my main office (where I am now working) is closing the foreign office where I come from. Based on L1 requirements and facts, it states that once the subsidiary closes, my L1 becomes invalid. Given this, the company is willing to sponsor my green card as soon as possible. It will probably still take a year before the subsidiary officially closes. What are my options? If they have to close the company while my green card is being process, would it be cancelled ?

    Thanks.

Tricky situation, many permutations. Check with a lawyer.

But I think if you file for I-140 asap you can lock in the PD. When that becomes current (chances are good if you are not from India/China) you can file for I-485, get your EAD+AP and continue working on the EAD.

Other option is to apply for a H1B change of status on the FIRST day the USCIS starts accepting applications. If you get approval, then it kicks in Oct 01, 2009. The odds of getting an approval are approximately 1 in 2. On the flip-side, you might have to restart your GC process and get a labor certification first.

What ever stopped the people in MA/NY/NJ to board the buses stopped the people in DC/VA/MD to get on to the Metro train and come to the rally. Its not the distance, as it may seem to you and me, But Its the lack of will, lack of commitment.

If people think about San Jose rally and think it was a huge success, people showed up in 2 days yada yada.., there is a diff reason. Does it even need to be mentioned?

All that I can tell you guys is we did more than our best to get the locals to get to the rally. We can only call/email them or give flyers and let them notify. The final 6 days, our active members had stood out at every place they could and distributed flyers to 3000-3500 people. All the six weeks they have been doing spreading the word.

I hope your message was just expressing disappointment by the turn out an was not actually questioning the commitment of the people who worked on this.

No body please question the commitment.
About the reason only GOD knows.

Buses were arranged from MA to DC, Tri-state to DC.
Buses were fully funded by IV. We just requested ppl to hop on and fight for their own cause.

Ppl were given every single thing to their doorsteps. We made phone calls, ran email campaigns asking and requesting ppl to share thei questions/concerns. What we did, we did it to our best. Rest is up to the ppl how much badly a change they need.

So, i hope ur post was to show ur disppointment with the ppl who did not show up, but not to challenge the commitments of any of the volunteers.

    GO IV GO
